Providing Knowledgeable Counsel for Post-Decree Issues
"Because things are the way they are, things will not stay the way they are. —Bertolt Brecht
When judges issue divorce orders, they attempt to effectively address both spouses' current needs and situations. However, those needs and situations can dramatically change over time. In such cases, it may be necessary to request a modification to the original court order.
I am attorney Deborah N. Dewalt, and at my Dakota County law firm, I assist and counsel individuals and families in a full range of post-decree matters. In addition to modifications, I handle all kinds of implementation issues. Whether you need help with an overdue Qualified Domestic Relations Order (QDRO), your spouse is not making the required child support payments or you simply have questions about what your decree means, you can count on me.
How to Modify Child Custody and Child Support Orders
In general, the Minnesota courts will only make changes to child custody orders if the change is clearly in the children's best interests. One compelling reason for a modification is if a child is being neglected or physically or emotionally abused by one parent.
Making changes to child support or spousal maintenance orders can also be difficult. However, the courts may modify existing orders if:
- Either parent loses his or her job
- A child requires special medical care
- A parent remarries or gains a higher paying job
- Either party becomes disabled or retires
- The cost of living increases significantly
If you need a modification to any divorce-related order, I can help you understand the court's statutory requirements, review your options and choose the best course of action to pursue your goals.
